- By bidding, you confirm you are legally able to contract and agree to these terms. If your bid is highest and meets reserve, you win and will receive an invoice. If outbid, you'll be notified, though the auctioneer isn't liable for missed notifications. Bids can be withdrawn at the auctioneer's discretion if manipulation is suspected. You're responsible for activity under your bidder number and password.
- If two bids are identical, the earlier one takes precedence. Auctioneer decisions in disputes are final. Technical issues may prompt the auction to be closed, reopened, or extended at the auctioneer's discretion. The auctioneer holds no liability for technical problems, site outages, security issues, or misuse of the platform.
- Registering with Ray White Rural Tara requires accurate personal details; you must be 18 or older and keep credentials secure. Do not re-register if your account is disabled.
- View lots in person before bidding—photos and descriptions are for guidance only. Buyers must ensure lots meet their intended use and legal requirements; workplace compliance is buyer’s responsibility. All purchases must be paid for and collected within three days unless otherwise stated. Uncollected assets after 60 days may be resold, with proceeds less costs held in trust.
- Collection is at the purchaser’s risk and cost. Ownership passes on full payment. Ray White staff help identify lots but won’t load or secure goods. Vendors warrant good title and authority to sell; Ray White Rural Tara relies on these warranties but disclaims all other guarantees except where prohibited by law.
- Disputes are resolved by the auctioneer in writing; verbal commitments are invalid. Lots are sold "as-is, where-is" regardless of inspection. No refunds or compensation for errors or faults unless misrepresented. Consumer guarantees don’t apply to auctions. Buyers should check for encumbrances prior to bidding.
- Payment must include winning bid, Buyer’s Premium, and fees; deposits may be required. Failure to pay or follow terms can result in forfeiture and further penalties, including resale and recovery of losses.
- No returns or allowances on auction lots. Refunds are only considered for material misrepresentation and require prompt return. Transportation back to vendor is at buyer’s expense.
- All bidders need a buyer number and must register. Highest bidder wins, subject to vendor acceptance. Bid prices usually include GST unless noted. The auctioneer may refuse bids or withdraw lots.
- On default, deposits are forfeited and lots resold. Inspection is recommended; sales are final and “as-is.” Vehicles are unregistered unless stated. The Vendor and auctioneer are not liable for loss or deficiency. Compliance with relevant safety laws for equipment is buyer’s responsibility.
